RESSALTA-SE, AINDA, QUE A ADMINISTRAÇÃO PÚBLICA POSSUI EXPERTISE INSTITUCIONAL E HISTÓRICO RECORRENTE NA AQUISIÇÃO DE MEDICAMENTOS E INSUMOS DESTINADOS AO ATENDIMENTO DE DEMANDAS JUDICIAIS, DISPONDO DE CONHECIMENTO TÉCNICO ACUMULADO SUFICIENTE PARA DEFINIÇÃO DAS ESPECIFICAÇÕES DO OBJETO, REQUISITOS SANITÁRIOS, CRITÉRIOS DE QUALIFICAÇÃO TÉCNICA E DEMAIS ELEMENTOS INDISPENSÁVEIS À ADEQUADA ELABORAÇÃO DO TERMO DE REFERÊNCIA, NÃO HAVENDO, PORTANTO, PREJUÍZO TÉCNICO, OPERACIONAL OU ADMINISTRATIVO DECORRENTE DA NÃO ELABORAÇÃO PRÉVIA DO ESTUDO TÉCNICO PRELIMINAR E DA ANÁLISE DE RISCOS NO CASO CONCRETO.
